Terms of Service – BeyondCal

Welcome to BeyondCal. These Terms of Service (“Terms”) govern your use of the BeyondCal mobile application (“App”) and the website beyondcal.com (together, the “Service”), operated by an individual based in Italy (“we”, “us”, “our”).

By creating an account, installing, or using the App, you agree to these Terms. If you do not agree, do not use BeyondCal.

1. Purpose of the App (Not Medical Advice)

BeyondCal is a nutrition tracking and education app focused on micronutrients, meal logging, and related analytics. It helps you understand your intake and build better habits.

BeyondCal does not provide medical advice and is not a medical device. It does not diagnose, treat, cure, or prevent any disease.

Nothing in the App should be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult your doctor or qualified health professional before making significant changes to diet, supplements, or medications.

You are solely responsible for how you use the information provided by the App.

2. Eligibility and Use of the App

You may use the App only for personal, non-commercial purposes and in compliance with applicable laws.

You must be at least 16 years old to use BeyondCal. If you are under 18, you should use the App only with the consent of a parent or legal guardian.

The App is not intended for children under 16. If we discover that a user is under this age, we may close the account and delete associated data, consistent with our Privacy Policy.

You agree not to misuse the Service, including (without limitation):

  • Attempting to gain unauthorized access
  • Reverse engineering, scraping, or automated data extraction
  • Using the App in a way that violates laws or third-party rights

3. Account and Security

You may need an account to use some or all features. Accounts may be created with email/password or with third-party sign-in (for example Apple or Google).

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account

If you suspect unauthorized access, you must contact us promptly at support@craftuplearn.com.

We reserve the right to suspend or close accounts that:

  • Violate these Terms
  • Are used for fraud, abuse, or other improper purposes

4. Subscriptions, In-App Purchases, and Billing

BeyondCal may offer paid features, subscriptions, or one-off in-app purchases (“Paid Services”).

Details of each plan (name, price, billing period, trial, included features) are displayed in the App Store / Play Store and inside the App at the time of purchase.

Purchases are processed by Apple App Store and/or Google Play (or other platform providers). We do not store your full payment card data.

Renewal and cancellation

Subscriptions typically auto-renew at the end of each billing period until you cancel.

You can manage or cancel your subscription in your App Store / Play Store account settings.

To avoid being charged for the next period, you must cancel at least 24 hours before the end of the current period (or as required by the store's rules).

Refunds

Refunds are normally handled directly by the platform (Apple, Google) under their own policies. We do not issue additional refunds outside what is required by applicable consumer laws.

5. User Content and Nutrition Data

By using BeyondCal you may provide:

  • Meal logs, foods, ingredients, photos of meals
  • Nutrition preferences, targets, and other profile data
  • Notes or tags about how you feel or your goals

Collectively, this is “User Content”.

You remain the owner of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and use it only to:

  • Provide and improve the Service
  • Personalize insights and analytics
  • Maintain security and reliability
  • Comply with legal obligations

We do not publicly publish your logs or photos within the App for other users to see.

You are responsible for ensuring that any information you provide is accurate and that you do not upload content that is illegal, offensive, or infringes on third-party rights.

6. AI-Powered Features

BeyondCal uses AI services (for example, from OpenAI or similar providers) to analyze meal photos and descriptions, estimate ingredients and portions, and generate insights.

You understand and agree that:

  • AI outputs may be imperfect, incomplete, or wrong.
  • All suggestions and estimates are informational only and may not reflect actual nutrient values or medical reality.
  • You must not rely solely on AI outputs for health decisions.

By using these features, you authorize us to send relevant data (such as meal photos and descriptions) to our AI providers strictly to operate these features, as described in our Privacy Policy.

7. Feedback

If you send feedback, ideas, or suggestions about BeyondCal, you grant us the right to use that feedback without restriction and without obligation to you, including without compensation. Feedback is optional, and you are not entitled to any ownership or compensation for product changes based on your feedback.

8. Intellectual Property

All rights in and to the App and Service, including:

  • Brand names, logos, and visual identity
  • App design, text, graphics, illustrations, and animations
  • Software, database structure, and algorithms

are owned by us or our licensors and are protected by copyright and other laws.

You may not, without prior written consent:

  • Copy, modify, distribute, or create derivative works
  • Resell or commercialize the App or its content
  • Remove or alter any copyright, trademark, or other proprietary notices

9. Privacy and Data Protection

Your use of BeyondCal is also subject to our Privacy Policy, available at https://beyondcal.com/privacy.

In short, we process personal data such as:

  • Account information (e.g. email, login details)
  • Nutrition logs and related health-style data you choose to provide
  • Device, usage, and diagnostic information
  • Push notification tokens

We process these data to provide and improve the Service, for security, and as otherwise described in the Privacy Policy and permitted by applicable law (including GDPR where relevant).

10. Termination and Suspension

We may suspend or terminate your access to the Service, with or without prior notice, if:

  • You materially breach these Terms
  • You misuse the App or attempt to compromise its security
  • We are required to do so by law or platform provider

You may stop using the App at any time and, where available, delete your account inside the App or by contacting us. Data handling after termination is described in the Privacy Policy.

11. Disclaimers

To the maximum extent permitted by law:

  • The Service is provided on an “as is” and “as available” basis.
  • We do not guarantee that the App will be uninterrupted, secure, or error-free.
  • We make no guarantees about specific health, weight, longevity, or performance results from using the App.
  • Any reliance on information provided by the App is at your own risk.

12. Limitation of Liability

To the fullest extent allowed by law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the App.

Where our liability cannot be excluded, it is limited to the total amount you have paid for the App or subscriptions in the 12 months prior to the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such limitation is prohibited by law (for example, in cases of gross negligence or intentional misconduct).

13. Force Majeure

We are not responsible for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, war, governmental actions, failure of telecommunications or hosting providers, platform outages, or strikes.

14. Changes to the Service and to These Terms

We may modify, suspend, or discontinue parts of the Service at any time, for example to add features, improve security, or comply with law.

We may update these Terms from time to time. If changes are material, we will notify you inside the App and/or by email. Continued use of the App after the changes become effective means that you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Italy, without regard to conflict of law rules.

If you have an issue, contact us first at support@craftuplearn.com so we can try to resolve it informally.

Where consumer protection laws do not require otherwise, any disputes will be subject to the courts of Milan, Italy.

16. Platform Terms (EULA)

For users who install BeyondCal through Apple platforms, these Terms supplement and incorporate the Apple Standard End User License Agreement (EULA). If there is a conflict between these Terms and the Apple EULA, the Apple EULA may apply where required by Apple's rules.

For users on other platforms, the respective store's terms and policies also apply.
