Welcome to BeyondCal. These Terms of Service (“Terms”) govern your use of the BeyondCal mobile application (“App”) and the website beyondcal.com (together, the “Service”), operated by an individual based in Italy (“we”, “us”, “our”).
By creating an account, installing, or using the App, you agree to these Terms. If you do not agree, do not use BeyondCal.
BeyondCal is a nutrition tracking and education app focused on micronutrients, meal logging, and related analytics. It helps you understand your intake and build better habits.
BeyondCal does not provide medical advice and is not a medical device. It does not diagnose, treat, cure, or prevent any disease.
Nothing in the App should be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult your doctor or qualified health professional before making significant changes to diet, supplements, or medications.
You are solely responsible for how you use the information provided by the App.
You may use the App only for personal, non-commercial purposes and in compliance with applicable laws.
You must be at least 16 years old to use BeyondCal. If you are under 18, you should use the App only with the consent of a parent or legal guardian.
The App is not intended for children under 16. If we discover that a user is under this age, we may close the account and delete associated data, consistent with our Privacy Policy.
You agree not to misuse the Service, including (without limitation):
You may need an account to use some or all features. Accounts may be created with email/password or with third-party sign-in (for example Apple or Google).

We reserve the right to suspend or close accounts that:
BeyondCal may offer paid features, subscriptions, or one-off in-app purchases (“Paid Services”).
Details of each plan (name, price, billing period, trial, included features) are displayed in the App Store / Play Store and inside the App at the time of purchase.
Purchases are processed by Apple App Store and/or Google Play (or other platform providers). We do not store your full payment card data.
Subscriptions typically auto-renew at the end of each billing period until you cancel.
You can manage or cancel your subscription in your App Store / Play Store account settings.
To avoid being charged for the next period, you must cancel at least 24 hours before the end of the current period (or as required by the store's rules).
Refunds are normally handled directly by the platform (Apple, Google) under their own policies. We do not issue additional refunds outside what is required by applicable consumer laws.
By using BeyondCal you may provide:

You remain the owner of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and use it only to:
We do not publicly publish your logs or photos within the App for other users to see.
You are responsible for ensuring that any information you provide is accurate and that you do not upload content that is illegal, offensive, or infringes on third-party rights.
BeyondCal uses AI services (for example, from OpenAI or similar providers) to analyze meal photos and descriptions, estimate ingredients and portions, and generate insights.
You understand and agree that:
By using these features, you authorize us to send relevant data (such as meal photos and descriptions) to our AI providers strictly to operate these features, as described in our Privacy Policy.
If you send feedback, ideas, or suggestions about BeyondCal, you grant us the right to use that feedback without restriction and without obligation to you, including without compensation. Feedback is optional, and you are not entitled to any ownership or compensation for product changes based on your feedback.
All rights in and to the App and Service, including:

We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the App.
Where our liability cannot be excluded, it is limited to the total amount you have paid for the App or subscriptions in the 12 months prior to the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where such limitation is prohibited by law (for example, in cases of gross negligence or intentional misconduct).
We are not responsible for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, war, governmental actions, failure of telecommunications or hosting providers, platform outages, or strikes.
We may modify, suspend, or discontinue parts of the Service at any time, for example to add features, improve security, or comply with law.
We may update these Terms from time to time. If changes are material, we will notify you inside the App and/or by email. Continued use of the App after the changes become effective means that you accept the updated Terms.
These Terms are governed by the laws of Italy, without regard to conflict of law rules.

Where consumer protection laws do not require otherwise, any disputes will be subject to the courts of Milan, Italy.
For users who install BeyondCal through Apple platforms, these Terms supplement and incorporate the Apple Standard End User License Agreement (EULA). If there is a conflict between these Terms and the Apple EULA, the Apple EULA may apply where required by Apple's rules.
